Phone users who received telemarketing calls from Farmers Insurance may qualify for a $425 cash payout

If your phone was slammed with unwanted marketing calls or texts from a Farmers Insurance agent, you could be owed a cash payment of up to $425. A new class-action settlement fund is paying out phone users over claims that the company violated federal law.

The lawsuit claims the telemarketing calls and texts violated the Telephone Consumer Protection Act (TCPA), a federal law that helps protect consumers from unwanted marketing communications. According to the plaintiffs, they never gave permission to receive the messages.

Farmers Insurance has not admitted any wrongdoing, but agreed to settle the lawsuit rather than continue with litigation.

Who actually qualifies for a payout?

Not everyone who has ever received a call from Farmers Insurance is eligible. The settlement is limited to people who received two or more telemarketing calls or text messages within a one-year period since Oct. 8, 2020, from either Todd Henderson Insurance Agency, Inc. or R. Todd Henderson.

There are a few additional requirements. Your phone number must have been listed on the National Do Not Call Registry for at least 30 days before the communications.

You'll also need to certify that you didn't request an insurance quote from Farmers or its agents before receiving the calls or texts and weren't a Farmers Insurance customer at the time.

You have two weeks to act

If you think you are eligible to get a share of this settlement, you'll need to submit a claim by July 24. The court is scheduled to hold a final approval hearing on July 31, and payments will be sent out after the settlement receives final approval.

Eligible class members can claim up to $425. Like many class action settlements, however, the final amount isn't guaranteed.
